Updating Wills

This is ESSENTIAL to ensure your wishes are carried out as your circumstances change during your life. Your Will needs updating as Events, Issues, Circumstances change in your Life such as: a new Baby, Grandchildren, the Beginning and End of a Relationship, getting Married or Divorced, buying or selling a new Home or Business.

Without updating your Will you will not ensure your assets are distributed on an up to date basis and your original Will will not cover everything off as you desire. This can lead to issues, challenges and frustration.

Enduring Powers of Attorney

Enduring Powers of Attorney are Legal Documents that enable you to appoint someone that you trust to make important decisions on your behalf if you are unable to make those decisions yourself due to Illness or Injury. This will enable that person to make any critical decisions regarding your well being, such as where you will live and who will look after you.

Note: if someone is going into a rest home they will be required to have a Will and an Enduring Powers of Attorney.

You can appoint someone or a specialist organisation to deal with your Finances and Property, deal with paying your bills and managing your Assets.

There are two types of Enduring Powers of Attorney: one is for Property and the other is for Personal Care and Welfare. You can decide to have one or both?

Essentially you will ensure that a person you trust will look after the things that matter to you.

By having an Enduring Power of Attorney you will have Peace of Mind that your Assets and Personal Welfare will be managed properly on a Temporary or Permanent basis by someone you trust if you are unable to do so. Without an Enduring Powers of Attorney if any important decisions are to be made or a document signed your Family or Friends must apply to the Family Court so they can help you or handle your affairs. This can take time and cost money. The Court may appoint someone that you would not choose.

Estate Administration

The Process of Estate Administration takes place to confirm all of the assets, items and debts of the Estate are confirmed and to hold the Estate Funds on Trust until they are ready to be distributed to the Beneficaries of the Estate. If there is a Will this is reviewed to see how the assets are to be distibuted. A Will makes the Estate Administration much easier, quicker and efficient.

Administration of an Estate generally entails four steps:

Identifying Assets and Property of the Deceased, getting control of the Property, paying Bills and any necessary Debts and Expenses, distributing Assets to the Beneficiaries.

The Estate Administration starts when you or a loved one passes away. The process finishes when everything has been distributed to the Beneficiaries. The Administration of the Estate includes a number of important things such as:

  • Distribution of assets and dealing with any debts
  • Updating the Beneficiaries of the Will and dealing with any issues
  • Dealing with Bank accounts, property, assets and personal items
  • Providing a final statement after the assets distribution is complete

There is a difference between Probate and Estate Administration. A grant of Probate proves the validity of a person’s Will and grants authority to the Executor of the Will. A grant of Administration is necessary when no Will can be found and an Executor must be appointed.
